Sufficiency of Notice

In order for a notice to be sufficient, such a notice should inform the adjoining property owner about the nature and extend of excavation, thus providing the neighbor to perform any necessary precautions to protect his or her property.  The notice should be served on time.  A notice given after the start of excavation, and once the adjoining soil has begun to slide is insufficient.

If the excavator changes excavation plans making the work more dangerous to the adjoining premises, the adjoining landowner has to be duly notified.
