A landowner who intends to excavate his or her property has to notify the adjoining landowner about the planned improvement. The adjoining property owner has to be given necessary time to take necessary precautions to protect the buildings on his or her land. It is very important to notify the adjoining property owner about the excavation when it appears that some precautionary works has to be done to protect the buildings in the adjoining property. Failure to notify amounts to negligence of the excavator and could be sufficient to justify a finding that the excavator did not use reasonable care in respect of the excavation. The excavator shall bee immune from liability for injury to the neighbor’s buildings if notice of excavation has been served properly
